TERMS AND CONDITIONS OF SERVICE

1. ACCEPTANCE OF TERMS

By accessing this website, booking a session, or making a payment, the Client agrees to be bound by these Terms and Conditions. This is a legally binding agreement between the Client and Alex Galloza Photography.

2. CLIENT’S ASSUMPTION OF RISK

Client accepts all responsibility for all persons present, and all injuries that they may receive and all property and/or personal damage caused and/or experienced by any individual. Photographer has no legal or financial liability to any individual attending this scheduled Photoshoot for any reason or cause.

3. RETAINER, BOOKING, & NON-PERFORMANCE

A retainer of 100% of the session fee is required to book and reserve the session date. In the event Photographer cannot perform the Session due to fire, casualty, act of God, illness, or emergency, Photographer shall return all monies paid to the Client. Photographer shall make every effort to find a qualified replacement or reschedule the session at the Client’s earliest convenience.

4. TAXATION & DELIVERY CATEGORIES

Under New York Law, delivery method determines taxability. Category A (Headshots/Minis): Digital-only delivery, no tangible property, tax-exempt. Category B (Seniors/Boudoir): Includes physical products (albums), making the entire session and product subject to NY Sales Tax.

5. ADMINISTRATIVE CANCELLATION FEES

If Client cancels before the session starts, a refund of the retainer is issued minus a non-refundable Administrative Fee: $50 (Headshots/Minis), $75 (Seniors/Portraits), or $100 (Boudoir). Once the session has commenced, all fees are non-refundable.

6. FEES AND ADDITIONAL COSTS

Client is responsible for all costs associated with the Session, including prop rentals, location fees, permits, parking, and any equipment rentals beyond the Photographer’s standard kit.

7. DUTY TO ARRIVE & THE 15-MINUTE RULE

Parties must arrive at the agreed time. Late arrival does not grant an extension of session time. If a client is more than 15 minutes late, the session is a "no-show," the session is canceled, and the full retainer is forfeited.

8. THE SATISFACTION GUARANTEE (RESHOOT REMEDY)

In lieu of refunds once a session has started, Photographer offers a one-time reshoot for the same package/location. Electing a reshoot voids and deletes all images from the original session. Deadline: Seniors/Portraits (within 48 hours of proofing); Headshots/Boudoir (before leaving the studio).

9. IMAGE SELECTION WORKFLOW

Headshot and Boudoir images are selected on-site at the conclusion of the session. Seniors, Portraits, and Minis must select final images via a proofing gallery within 7 days of receipt.

10. DELIVERY TIMELINES

Final delivery begins after selection: Professional Headshot (1–2 Days); Corporate Headshot (2–3 Days); LinkedIn Express (5–7 Days); Portraits, Seniors, & Minis (14 Business Days). If Photographer exceeds the delivery timeline by more than 7 days without prior notice, Client shall receive one (1) additional retouched digital image at no cost.

11. ADDITIONAL SERVICE FEES

Digital images for Headshots only are $95 per image. Rush service (24-48 hours) is available for $50 (LinkedIn/Minis) or $75 (Portraits/Seniors/Boudoir).

12. ARCHIVING & RETRIEVAL

Galleries are hosted for 60 days. Unselected images are purged after 6 months. Retrieval of a gallery after the initial 60-day hosting period incurs a $75 fee.

13. COPYRIGHT, AI, & SENSITIVE USE

Alex Galloza retains copyright. Client is granted a non-exclusive license for personal/professional use. No filters, AI-generative tools, or excessive cropping allowed. RAW files are never delivered. Photographer agrees images will be used strictly for the promotion of Alex Galloza Photography and will not be sold to third-party stock agencies. For Boudoir sessions, no images will be shared publicly without a separate, specific Social Media Release.

14. INDEMNIFICATION & DATA PROTECTION

Client agrees to indemnify and hold harmless Photographer from all claims, including likeness use or injury. Photographer maintains a professional backup workflow; however, in the unlikely event that images are lost through technical failure or theft, Photographer’s liability is limited to a full refund of the session fee and one (1) complimentary reshoot to replace the lost images.

15. SAFETY & THE STOP RULE

Photographer may end a session for harassment or unsafe conditions. Client may end a session for discomfort. Client must raise concerns as they arise; following directions without objection assumes full responsibility. If stopped, the "No Refund" policy stands, and the "Reshoot Remedy" is the only available recourse. For Senior sessions, a parent or legal guardian must be present for the duration.
